Iowa Court To Reconsider Fired-For-Flirting Sexual Discrimination Case

  • The Iowa Supreme Court will reconsider the sexual discrimination case of  Melissa Nelson, who was fired by her male boss James Knight. Knight was caught flirting with Nelson by his wife and eventually fired Nelson because he claimed he found her too sexually attractive to not be a distraction to his marriage. Back in December, an all-male court of seven judges ruled that Knight was not discriminating based on her gender, but simply on the fact he found Nelson “irresistible.” [ABC News]

What Walmart’s Gender Discrimination Lawsuit Victory Will Mean For Women

Over a million women cannot sue Walmart as a class in a class-action lawsuit for sexual discrimination, the Supreme Court ruled today. The the womens’ class-action lawsuit, the largest in history, comprised past and present Walmart employees who said they were systematically oppressed by the company, paid less and denied promotions at stores throughout the country. The New York Times reports the court felt the lawsuit was filed improperly regarding class action rules.

Something is rotten in the state of Georgia: narcotics K-9 officer Ruth Hernandez was fired by the city of Thomsen, Georgia after getting pregnant.

According to WAGT-TV, Ruth Hernandez became pregnant with her second child and told her superiors that she couldn’t perform her duties until November 11 (eight months from now). Obviously if she is pregnant, it is ill-advised for her be in dangerous positions that cops can find themselves in. Fortunately, by federal law, if an employee cannot perform a duty because of a disability — which is how pregnancy is viewed by the law — the employer is supposed to try to find a similar job that he or she can do. For instance, Thomson, Georgia, was hiring for a secretary, which is a desk position, in its fire department. However, Ruth Hernandez says she was never offered the secretarial position. Nor did the city of Thomson offer her a leave. Instead, she was fired by Thomson PD, which said in a statement to WAGT, it was “unable to hold her position vacant for the length of time requested.” Her police car and her K-9 dog have been given to another officer and Ruth is now unemployed.

Beginning next week, Walmart will go before the Supreme Court to defend itself in the largest class action sexual discrimination lawsuit in history. Walmart is accused of allegedly paying female employees less and favoring male employees for promotions at its 3,400 big box stores nationwide.

Today’s Lady News: Performing Sexual Favors Totally Fine For Women In Politics, Says Italian Dude

  • It’s totally OK if women use their bodies to get ahead in politics, advises Giorgio Stracquadanio, an ally of Silvio Berlusconi, the prime minister of Italy (who has made plenty of sexist comments himself). Stracquadanio added that, in his opinion, a woman performing sexual favors to get ahead would not be grounds for dismissal. Being a woman working in Italian government must be a ball. [Telegraph UK]

Today’s Lady News: Teacher Canned For Premarital Sex

  • Jarretta Hamilton, a fourth grade teacher in St. Cloud, Florida, was fired for getting pregnant while she was engaged. When Hamilton’s boss at Southland Christian School asked her when she conceived, she answered honestly that she got pregnant three weeks before her wedding and was then fired for “fornication.” Now Southland Christian School is facing a discrimination lawsuit, arguing that pregnant, unmarried women would be fired under such rules while unmarried men who “fornicate” would not get caught. Today’s Lady News: Wal-Mart Lawyers Warned Company Of Sexual Discrimination Lawsuit

  • Wal-Mart is the focus of the largest sexual discrimination lawsuit in history, but in 1995 the company actually hired a law firm to research their vulnerability to such a suit. A subsequent report found disparities in pay and promotion among men and women employed by the company as well as Sam’s Club. Men were found to earn 19 percent more than women in some positions and were found to be five and a half times more likely to be promoted. In 2001, seven women filed a class-action lawsuit against Wal-Mart. [New York Times]
  • Black men are more frequently marrying women of other races, according to a study released today by the Pew Research Center. Interracial unions now account for one in six new marriages in the United States, a new high. Blacks and Caucasians are the least common type of interracial marriages (1 in 60 marriages) and unions between Asians and Caucasians are the most common. [New York Times]

Today’s Lady News: Golf Gal Wins Sexual Discrimination Lawsuit

  • A Massachusetts judge has ruled in favor of golfer Elaine Joyce, in a sexual discrimination lawsuit she filed against the town of Dennis, MA. In 2007, Joyce was banned from playing in a men’s tournament at the town’s municipal Dennis Pines Golf Course despite the fact she has a single-digit handicap. Last week, a judge ruled the club violated Joyce’s civil rights. Golf course club officials have since changed their rules to allow women to compete in men’s tournaments. [AP]
  • Oklahoma Governor Brad Henry signed three bills placing restrictions on abortion into law this morning. One bill bans abortions based on a child’s gender, one allows medical employees to refuse to participate in abortions if it is against their religious beliefs, and one regulates the administration of RU-486, the abortion pill.   • Jay-Z and Russell Simmons will rally this weekend at a “Stop The Violence” rally in Trenton, New Jersey, organized after a 7-year-old girl was sold for sex by her sister and gang-raped by numerous people at a March 28 party. So far, five men and boys have been arrested and police say they are seeking additional suspects. Ludacris and Chuck D. will also deliver taped messages to the rally’s attendees. [AllHipHop.com]
