During her marriage to Erwin Cajamarca, Valeria Gentile allowed him to take photographs of her nude in a variety of sexual positions. Now that they're divorced, she's suing him for putting some of those photos online, resulting in a humiliating and cruel "invasion of her privacy." According to a divorce attorney, both partners legally own photographs taken during the course of a marriage and deciding who gets to keep them after the relationship ends is one of the more contentious issues discussed during divorce settlements. To me its obvious that whoever appears IN the photograph should keep it. I have a couple of naked pics of my exes, lol. I don’t think i’d ever put them on the internet, that’s so mean! I just rely on Karma to get them back for any wrong doing.

this wasn’t an option, but here’s what I really think:
Whoever wants them more should get to keep them, so long as there is a written agreement that said pictures will not be used against the other, either as blackmail, or as a technique of humiliation. Otherwise, if the agreement is broken, and your nudy pics end up in an email to your deeply religious grandmother, you could sue the bajeezus out of them.

I agree with betty123 100%. If you don’t want to worry about it later, just don’t do it and save yourself the headache.
But, of the three options, I say whoever took it, as long as they had permission, gets to keep it. It’s like giving a gift to someone: if it’s something you gave freely, then you don’t get to take it back. You can ask, of course, but it already belongs to the other person, and then all you can do is hope they won’t be a big enough jerk to refuse to return it.

Yeah lawyers always want you to discuss something—-during their billable hours. Heck no, a gentleman would return the pix to a lady. A lady would ask if a man if he wants his back or offer to return them. Or like Betty123 wrote just don’t do it. Usually it turns out badly for much younger people who are immature enough to use private photos as “get back” for hurt feelings. Its just so high school.
