Dzhokhar Tsarnaev has regained consciousness and has been giving investigators written answers to questions, law enforcement sources tell ABC, though it’s unclear if he’s actually saying anything useful yet. Sources tell Fox News that he will not be formally charged today. The Boston bombing suspect is listed as in serious but stable condition at the Beth Israel Deaconess Medical Center, with neck and throat injuries that prevent him from talking. “Furious” Gabrielle Giffords Says Senate Shamed Itself

It was “political fear” and “cold calculations” that drove a Senate minority to block a gun background-check measure yesterday. But “that fear must be nothing compared to the fear the first graders in Sandy Hook Elementary School felt as their lives ended in a hail of bullets,” writes Gabrielle Giffords in a blistering New York Times op-ed. Some of those senators have met with Newtown victims, “have looked into my eyes” as Giffords discussed her own shooting. Senate Rejects Tougher Background Checks

As predicted, the Senate today rejected a bipartisan effort to expand federal background checks on gun purchasers. The proposal would have required checks for all transactions at gun shows and online. The 54-46 vote was a blow to the drive to curb firearms sparked by December’s massacre of children and staff in Newtown. Suspicious Letter To President Obama Intercepted

A letter containing a “suspicious substance” was sent to President Obama and intercepted at the White House’s off-site mail center, according to the Secret Service. It arrived yesterday, the same day as a letter addressed to a Mississippi Republican Sen. Roger Wicker that tested positive for ricin, CNN reports. A second letter sent to the US Senate has also been intercepted and is being tested for the poison, the AP reports; Terry Moran of ABC News tweets that that second letter also tested positive. Annette Funicello Dead At 70

Annette Funicello, who shot to fame at age 12 as a Disney Mouseketeer, has died from complications of multiple sclerosis at age 70, her family confirms to Extra. Funicello parlayed her Disney fame into a successful singing and acting career perhaps most noted for her “Beach Party” movies with Frankie Avalon in the 1960s. “You knew she was very attractive, very pretty and voluptuous, but Annette never flaunted it,” Avalon, now 75, told People in 1998. “She underplayed everything.
